1. Acceptance of Terms

By accessing or using TouchBattle ("the Service"), operated by PingSolve LLC. ("Company", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

TouchBattle is a competitive mobile game that tests players' endurance and reflexes. The Service allows users to:

• Play single-player and multiplayer game modes
• Track scores and rankings on leaderboards
• Customize their in-game appearance
• Upgrade to premium features

3. User Accounts and Responsibilities

To use certain features of the Service, you may be required to create an account. You are responsible for:

• Providing accurate and complete information during registration
• Maintaining the security of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account
• Complying with all applicable laws and regulations

Prohibited Usernames and Display Names: Users shall not create, use, or display any username, display name, or other identifier that PingSolve LLC, in its sole discretion, deems to be offensive, obscene, defamatory, harassing, discriminatory, infringing, unlawful, or otherwise harmful. PingSolve LLC reserves the right to review, monitor, remove, suspend, or terminate any account or access to its services found to be in violation of this provision and to pursue any and all legal remedies available under applicable law.

PingSolve LLC shall not be held liable or responsible for any damages, losses, liabilities, or injuries arising from or relating to a user's creation, use, or public display of any prohibited name or identifier. Users acknowledge and agree that they are solely responsible for any consequences arising from their chosen identifiers and any resulting harm to others.

By accessing or using the services provided by PingSolve LLC, users acknowledge and understand that they may be exposed to content, usernames, or identifiers created by other users that may be offensive, inappropriate, or otherwise objectionable. Users agree that PingSolve LLC shall not be held liable in any manner for the presence, display, or continued accessibility of such content and that their sole remedy shall be to discontinue use of the service or report the offending content through the designated reporting mechanisms provided by PingSolve LLC.

4. Intellectual Property Rights

The Service and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of PingSolve LLC and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of PingSolve LLC.

5. User Conduct

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Engage in fraudulent or deceptive practices
• Interfere with or disrupt the Service or servers
• Attempt to gain unauthorized access to any part of the Service
• Use the Service for any commercial purpose without our written consent
• Create multiple accounts to circumvent restrictions
• Cheat, exploit bugs, or use automation software (bots) to gain an unfair advantage

6. In-App Purchases & Virtual Items

The Service may include virtual items or currency ("Virtual Goods"). You agree that:

• Virtual Goods have no real-world value and cannot be redeemed for cash or other value.
• You have a limited, revocable, non-transferable license to use Virtual Goods.
• PingSolve LLC reserves the right to manage, regulate, control, modify, or eliminate Virtual Goods at any time, with or without notice.
• Purchases such as "Premium Upgrade" are non-consumable and permanently unlock certain features (e.g., removing ads and unlocking styles).
• You can restore previous purchases using the Restore Purchases option in the App.
• All purchases are final and non-refundable, except as required by law. Refunds are handled in accordance with Apple's refund policy: https://support.apple.com/en-us/HT204084

7. Advertisements

The free version of the App displays ads provided by Google AdMob. We make efforts to ensure that ads are appropriate and do not disrupt gameplay, but we are not responsible for ad content shown by third-party networks.

8. Discontinuation, Modification, and Termination

We reserve the right to modify, suspend, or discontinue the App, or any feature or service provided through the App, at any time and for any reason, without prior notice or liability to you. This includes, but is not limited to, the right to permanently or temporarily disable access to the App, remove it from the App Store, or shut down any associated online services or servers.

If you have made a one-time purchase (such as a premium upgrade), you understand and agree that such purchase grants you access to premium features only while the App is available and supported. We make no guarantee of continued availability or maintenance of the App or its online services.

In the event of discontinuation or termination, we are not obligated to provide any refunds or compensation except where required by applicable law or App Store policy. Your right to use the App will automatically terminate upon discontinuation.

We may also terminate or suspend your access to the App if you violate these Terms or engage in activity that we deem harmful to the App or its users.

Upon termination for any reason, all licenses and rights granted to you under these Terms will immediately cease, and you must cease all use of the App.

9. Server and Online Functionality

Certain features of the App may rely on online connectivity or servers that we operate or control. We do not guarantee that such services will remain available indefinitely, and we may cease providing them without liability to you.

10. Disclaimers and Limitation of Liability

Service Availability: The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance. We do not guarantee uninterrupted or error-free service.

Limitation of Liability: To the maximum extent permitted by law, PingSolve LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

11. Indemnification

You agree to defend, indemnify, and hold harmless PingSolve LLC and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password; or b) a breach of these Terms.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration.

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will notify users of material changes via email or through the Service. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.
