Terms of Use

Away Isles  |  Effective Date: October 31, 2026  |  Last Updated: October 31, 2026

These Terms of Use (“Terms”) are a legally binding agreement and End User License Agreement between you (“you” or “User”) and PingSolve LLC (“PingSolve,” “we,” “us,” or “our”). They govern your use of the mobile application Away Isles and its widgets, Live Activities, Circles, Away Isles Plus subscription, island purchases, and related services (together, the “App”).

By downloading, installing, accessing, or using the App, or by creating an account, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App, and delete it from your device.

Important Legal Notice — Read Before Using

Binding Arbitration. All disputes arising out of or relating to these Terms or the App will be resolved through final and binding individual arbitration administered by the American Arbitration Association (“AAA”) in Boise, Idaho, and not in a court of law. See Section 18.

Jury Trial & Class Action Waiver. You waive any right to a trial by jury and any right to bring or join a class, collective, or representative action.

Not Medical or Safety Advice. Away Isles is a focus and habit app. It is not a medical, mental-health, parental-control, or safety product, and it does not guarantee that any app will be blocked or that you will be reachable. See Sections 4 and 5.

Limitation of Liability. The App is provided “as is” with no warranties of any kind, and PingSolve LLC's total liability to you is strictly limited as set out in Section 14.

1. Acceptance and Eligibility

You represent and warrant that: (a) you are at least 13 years of age; (b) if you are under 18 (or the age of majority where you live), your parent or legal guardian has read and agreed to these Terms on your behalf and is responsible for your use of the App; (c) you have the legal capacity to enter into a binding agreement; and (d) you are not located in a country subject to a U.S. Government embargo, and you are not listed on any U.S. Government list of prohibited or restricted parties.

The App is not directed to children under 13, and children under 13 may not create an account or use Circles. Parents and legal guardians are solely responsible for supervising a minor’s use of the App and are fully responsible for the acts and omissions of that minor, including any content the minor shares and any purchase made on the minor’s Apple Account.

2. License Grant

Subject to your continuous compliance with these Terms, PingSolve grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to download, install, and use the App for your personal, non-commercial purposes on Apple-branded devices that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.

This is a license, not a sale. PingSolve and its licensors keep all right, title, and interest in and to the App, including all islands, artwork, keepsakes, lantern designs, and other content. All rights not expressly granted are reserved.

3. Accounts

You can use the App’s solo features without an account. Circles and some Plus features require an account created with an email address and password, Sign in with Apple, or Google Sign-In. You agree to give accurate information, to keep your sign-in credentials secure, and to tell us promptly at support@pingsolveai.com if you believe your account has been used without your permission. You are responsible for all activity under your account.

You may delete your account at any time in the App under Account → Delete account. Deletion is described in our Privacy Policy. Deleting your account does not cancel an App Store subscription; you manage and cancel subscriptions in your Apple Account settings.

4. Screen Time, Focus Sessions, and Device Restrictions

The App uses Apple’s Screen Time frameworks to restrict apps and websites you choose during a focus session. You choose what is restricted, and you can end a session or regain access through the App and through iPhone or iPad Settings.

  • You are solely responsible for the apps you choose to restrict and for the timing and length of your sessions. Do not restrict any app you may need for your health, safety, work, school, transportation, navigation, communication with caregivers, or emergencies.
  • The App does not guarantee that any app or website will be blocked, that restrictions will start, stop, or end on time, or that restrictions will survive a device restart, an iOS update, a change in Screen Time settings, or a defect. Restrictions depend on Apple’s systems, which we do not control.
  • The App does not guarantee that you will be reachable or that notifications, messages, or calls will be delivered or noticed during a session.
  • The App is not a parental-control, monitoring, or child-safety product, and it must not be used to restrict another person’s device without that person’s knowledge and lawful consent.
  • Never use the App while driving or operating a vehicle or machinery.

To the maximum extent permitted by applicable law, PingSolve is not liable for any missed call, message, alarm, appointment, deadline, payment, opportunity, or emergency, or any other loss, arising from restrictions you set up in the App or from their failure to start, stop, or work as expected.

5. Not Medical, Mental-Health, or Professional Advice

Away Isles is designed to make focus and breaks from your phone feel calmer. Its content, reminders, encouragement, and statistics are for general and entertainment purposes only and are not medical, psychological, therapeutic, or professional advice, diagnosis, or treatment. Focus minutes, streaks, and other numbers in the App are estimates that may be incomplete or inaccurate. If you are concerned about your phone use, attention, sleep, or mental health, talk to a qualified professional. If you are in crisis or in danger, contact your local emergency services.

6. Circles, Shared Goals, Rewards, and Lanterns

Circles are small, invite-only groups. Members can see each other’s display names, the circle name, shared goals and their notes, reward descriptions, and, only if you turn it on, your shared island and goal progress. Members can send each other short encouragement messages (“lanterns”).

  • Rewards are private promises between members. The App only records the text of a promised reward and whether people have marked it given or received. PingSolve does not buy, provide, hold, guarantee, deliver, or enforce any reward, and PingSolve is not a party to any arrangement between members. Any dispute about a reward is solely between the members involved.
  • Rewards must be lawful and must not involve gambling, wagers, betting, money-for-chance arrangements, alcohol, tobacco, cannabis, drugs, weapons, sexual content, or anything unsafe or inappropriate for minors.
  • Only invite people you know. You are responsible for whom you invite and for sharing invite codes only with people you intend to join.
  • Circle organizers can rename or close a circle and remove members. Any member can leave a circle at any time. Anyone can turn off receiving lanterns, entirely or per circle, and block a sender.

To the maximum extent permitted by applicable law, PingSolve is not responsible for the conduct of any circle member, any content a member shares, any reward or promise between members, or any interaction between members on or off the App.

7. Your Content and Community Rules

“Your Content” means the text you enter and share in the App, such as your display name, circle names, goal titles, goal notes, reward descriptions, and lantern messages. You keep ownership of Your Content. You grant PingSolve a worldwide, non-exclusive, royalty-free license to host, store, copy, transmit, and display Your Content solely to operate the App and provide it to the people you share it with.

PingSolve has zero tolerance for objectionable content or abusive users. You agree not to use the App to post, send, or share anything that:

  • harasses, bullies, threatens, intimidates, stalks, or demeans any person;
  • is hateful or discriminatory based on race, ethnicity, national origin, religion, disability, sex, gender identity, sexual orientation, age, or any other protected characteristic;
  • is sexually explicit, pornographic, or sexualizes minors in any way;
  • promotes or depicts violence, self-harm, suicide, eating disorders, or dangerous activities;
  • is false or misleading, impersonates any person, or misrepresents your identity or age;
  • contains spam, advertising, solicitations, or links to malicious content;
  • infringes anyone’s intellectual property, privacy, or publicity rights, or shares another person’s private information without consent; or
  • is otherwise unlawful or promotes unlawful activity.

Filtering and reporting. The App automatically rejects names, goals, rewards, and messages that contain language we do not allow; no filter is perfect. To report content or a user, use the Report option on a lantern, goal, or circle member in the App, or email support@pingsolveai.com with the circle name, the content, and the display name of the person involved. We review reports and aim to act on them within 24 hours. We may remove content, remove a user from a circle, close a circle, or suspend or terminate an account that violates these Terms, at our sole discretion and without notice. We are not obligated to monitor content, and we do not endorse any content shared by users.

You are solely responsible for Your Content and agree to indemnify PingSolve for any claim arising from it.

8. Prohibited Conduct

You shall not, and shall not permit any third party to: (a) copy, modify, adapt, translate, or create derivative works of the App; (b) reverse engineer, decompile, disassemble, or attempt to derive the source code of the App, except to the extent applicable law expressly prohibits this restriction; (c) remove, obscure, or alter any proprietary notice; (d) rent, lease, lend, sell, sublicense, distribute, or transfer the App; (e) circumvent, disable, or interfere with any security, purchase verification, or entitlement mechanism; (f) access the App or its servers with any automated system, bot, scraper, or emulator, or interfere with or overload them; (g) create accounts by automated means or under false pretenses; (h) use the App to harass, monitor, or restrict another person; or (i) use the App for any unlawful purpose.

9. Away Isles Plus Subscription

Away Isles Plus is an optional auto-renewing subscription, offered monthly and annually, that unlocks additional features described in the App. The current price for your storefront is shown in the App and on Apple’s confirmation sheet before you buy.

  • Payment is charged to your Apple Account at confirmation of purchase.
  • Your subscription renews automatically at the same price for the same period unless you turn off auto-renew at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period.
  • You can manage or cancel your subscription in your Apple Account settings at any time. Cancellation takes effect at the end of the current paid period; you keep access until then.
  • If a free trial or introductory offer is offered, any unused portion is forfeited when you purchase a subscription, where applicable.
  • Circle members who join a goal or receive a lantern do not need Plus.

10. Island Purchases

The App offers optional one-time, non-consumable purchases that unlock additional islands. A purchase can be restored to the same Apple Account at no additional charge using Restore purchases. Restoration depends on Apple’s systems, which we do not control.

11. Payments and Refunds

  • All purchases are processed by Apple under the Apple Media Services Terms and Conditions. PingSolve does not process payments and never receives your payment card details.
  • Prices vary by storefront and currency and may change. The price shown on Apple’s confirmation sheet at the moment of purchase governs.
  • All purchases are final. PingSolve does not issue refunds and has no ability to do so. All refund requests must be made to Apple at reportaproblem.apple.com, under Apple’s refund policies.
  • Purchased content and features are licensed, not sold, and are available only while the App remains available and functional. We do not guarantee perpetual availability of the App, any island, any feature, or any content. Features and content may change as the App is updated.

12. Third-Party Services

The App relies on third-party services including Apple (App Store, Sign in with Apple, Screen Time, WeatherKit, push notifications), Google (Firebase and Google Sign-In), and Expo (push notification delivery). PingSolve does not control and is not responsible for any third-party service, its availability, accuracy, performance, security, or conduct. Weather shown in the App comes from Apple Weather and may be inaccurate; do not rely on it for safety decisions. Your use of a third-party service is governed by that party’s own terms.

13. Disclaimer of Warranties

The app is provided on an “as is” and “as available” basis, with all faults, and without warranties or representations of any kind, whether express, implied, statutory, or otherwise.

To the maximum extent permitted by applicable law, PingSolve LLC expressly disclaims all warranties, including the implied warranties of merchantability, fitness for a particular purpose, title, quiet enjoyment, accuracy, and non-infringement, and any warranties arising from course of dealing, usage, or trade practice.

Without limiting the foregoing, PingSolve makes no warranty that the app will be uninterrupted, timely, secure, error-free, or compatible with your device; that restrictions, reminders, notifications, widgets, or live activities will work as expected; that your progress, islands, or other data will be preserved; or that any defect will be corrected.

Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you. In that case, those warranties are limited to the minimum period and the maximum extent permitted by applicable law.

14. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall PingSolve LLC or its owners, members, managers, officers, employees, contractors, agents, licensors, suppliers, successors, or assigns be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenue, data, progress, goodwill, or opportunity, arising out of or relating in any way to these terms or the app, whether based in contract, tort (including negligence), strict liability, warranty, or any other legal theory, and even if PingSolve has been advised of the possibility of such damages.

Without limiting the foregoing, PingSolve shall have no liability for any loss arising from restrictions you set, missed communications, the conduct or content of other users, rewards or promises between users, or any loss of islands, progress, or data.

PingSolve LLC's total aggregate liability for all claims arising out of or relating to these terms or the app shall not exceed the greater of (a) the total amount you actually paid to Apple for the app and in-app purchases in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) five United States dollars (US$5.00).

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, or the limitation of liability for personal injury caused by negligence, so some of the above limitations may not apply to you. In those jurisdictions, PingSolve’s liability is limited to the smallest amount permitted by applicable law. These limitations are an essential basis of the bargain and apply even if a limited remedy fails of its essential purpose.

15. Indemnification

You agree to defend, indemnify, and hold harmless PingSolve LLC and its owners, members, managers, officers, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against all claims, demands, actions, liabilities, damages, judgments, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) your use or misuse of the App; (b) Your Content; (c) any reward, promise, or arrangement between you and another user; (d) your violation of these Terms or of any law; (e) your violation of any third party’s rights; and (f) the use of the App by any minor you are responsible for. PingSolve may, at your expense, assume the exclusive defense and control of any matter subject to indemnification, and you agree to cooperate with that defense.

16. Apple-Required Terms

The following provisions apply because the App is distributed through the Apple App Store, and they control over any conflicting provision of these Terms:

  1. Parties. These Terms are concluded solely between you and PingSolve LLC, and not with Apple Inc. (“Apple”). PingSolve, not Apple, is solely responsible for the App and its content.
  2. Scope of License. The license granted to you is limited to a non-transferable license to use the App on any Apple-branded product that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the App may be accessed and used by other accounts associated with you through Family Sharing or volume purchasing, where applicable.
  3. Maintenance and Support. PingSolve is solely responsible for providing any maintenance and support services for the App. Apple has no obligation whatsoever to furnish any maintenance or support services for the App.
  4. Warranty. PingSolve is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever for the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are PingSolve’s sole responsibility, subject to Sections 13 and 14.
  5. Product Claims. PingSolve, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and use of it, including: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
  6. Intellectual Property Claims. If a third party claims that the App or your possession and use of it infringes that third party’s intellectual property rights, PingSolve, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of that claim.
  7. Legal Compliance. You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
  8. Developer Contact. Questions, complaints, and claims about the App should be sent to PingSolve LLC at support@pingsolveai.com.
  9. Third-Party Terms. You must comply with applicable third-party terms of agreement when using the App.
  10. Third-Party Beneficiary. Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

17. Termination

These Terms remain in effect until terminated. PingSolve may suspend or terminate your account or your license at any time, with or without notice, for any reason, including any suspected breach of these Terms. You may stop using the App at any time by deleting your account and deleting the App. Termination does not entitle you to any refund. Sections 4 through 7, 11 through 16, 18, and 19 survive termination.

18. Governing Law, Arbitration, and Class Action Waiver

Governing Law. These Terms are governed by the laws of the State of Idaho, without regard to its conflict of law principles, and excluding the United Nations Convention on Contracts for the International Sale of Goods.

Informal Resolution First. Before starting any arbitration or other proceeding, you agree to email a written description of your claim to support@pingsolveai.com and allow PingSolve at least thirty (30) days to try to resolve it in good faith.

Binding Individual Arbitration. All disputes, claims, or controversies arising out of or relating to these Terms, the Privacy Policy, or the App, including their existence, breach, termination, enforcement, interpretation, or validity, shall be resolved exclusively through final and binding individual arbitration administered by the American Arbitration Association in Boise, Idaho, under its Consumer Arbitration Rules. The arbitration may be conducted by video or in writing where the rules allow. Judgment on the award may be entered in any court of competent jurisdiction.

Class Action Waiver. All claims must be brought solely in your individual capacity and not as a plaintiff or class member in any purported class, collective, consolidated, private attorney general, or representative action. The arbitrator may not consolidate the claims of more than one person and may not preside over any form of representative proceeding. If this class action waiver is found unenforceable as to any claim, that claim shall be severed and decided in the state or federal courts located in Ada County, Idaho, while all remaining claims proceed in arbitration.

Jury Trial Waiver. You and PingSolve each waive any right to a trial by jury.

Small Claims & Injunctive Relief. Either party may bring an individual action in small claims court, and PingSolve may seek injunctive or equitable relief in any court of competent jurisdiction to protect its intellectual property.

Time Limit. Any claim must be filed within one (1) year after it arises, or it is permanently barred, to the maximum extent permitted by applicable law.

Nothing in this section limits rights that cannot be limited under applicable law, including mandatory consumer protection laws of the country where you live.

19. General Provisions

Severability. If any provision of these Terms is held invalid, illegal, or unenforceable, it will be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, and the remaining provisions remain in full force and effect.

No Waiver. No failure or delay by PingSolve in exercising any right operates as a waiver of that or any other right.

Assignment. You may not assign or transfer these Terms or any rights under them. PingSolve may assign these Terms freely, including in connection with a merger, acquisition, reorganization, or sale of assets.

Entire Agreement. These Terms, together with the Privacy Policy, are the entire agreement between you and PingSolve regarding the App and supersede all prior or contemporaneous understandings.

Changes to These Terms. PingSolve may revise these Terms by posting a revised version at this URL and updating the “Last Updated” date. For material changes, we may also give notice in the App. Your continued use of the App after a revision is posted constitutes acceptance of the revised Terms.

Force Majeure. PingSolve is not liable for any failure or delay resulting from any cause beyond its reasonable control.
