These Terms of Service ("Terms") govern your access to and use of the CustomCast website (customcast.live), web application, and all related services, features, content, and functionality (collectively, the "Services"), operated by PingSolve LLC ("Company," "we," "us," or "our").

BY ACCESSING OR USING THE SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE LEGALLY BOUND BY THESE TERMS AND OUR PRIVACY POLICY. IF YOU DO NOT AGREE TO ALL OF THESE TERMS, YOU MUST IMMEDIATELY CEASE ALL USE OF THE SERVICES.

1. ELIGIBILITY

You must be at least 13 years old to access or use the Services. If you are under the age of 18 (or the age of majority in your jurisdiction), you may only use the Services under the supervision of a parent or legal guardian who agrees to be bound by these Terms.

Parents or legal guardians utilizing the Parental Sandbox or Voice Tutor for their minor children are fully responsible for the child's activity and compliance with these Terms.

2. DESCRIPTION OF SERVICES

CustomCast provides an interactive voice companion that answers questions, explains complex concepts, and summarizes topics in real-time while you watch YouTube videos. CustomCast retrieves video metadata, transcripts, and playback content using public API integrations (including YouTube API Services).

3. CONTENT & THIRD-PARTY PLATFORM DISCLAIMER

You expressly acknowledge and agree that:

All transcriptions, answers, and summaries generated by CustomCast are automated interpretations of third-party video content and are NOT guaranteed to be correct or safe.
CustomCast does not control, review, or endorse the video content available on YouTube or any other video host platforms.
You are solely responsible for ensuring your compliance with the terms of use of third-party video platforms.

4. AI DISCLAIMER (CRITICAL)

The Services utilize artificial intelligence and machine learning technologies that:

May generate inaccurate, incomplete, inconsistent, or misleading responses at any time.
May hallucinate or misinterpret spoken text in videos.
Do NOT replace your own independent verification of facts or source information.

No Warranties on AI Outputs

ALL AI-GENERATED CONTENT IS PROVIDED STRICTLY "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

5. USER RESPONSIBILITIES & CODE OF CONDUCT

By using the Services, you agree and acknowledge that:

You will not submit audio or text inputs that are offensive, illegal, harassing, or violate the intellectual property rights of any party.
You use the voice companion entirely at your own risk.
You will comply with all local, state, and federal laws regarding online safety and recording.

6. USER LICENSE TO INPUTS

You retain ownership of any original text queries or voice recordings you submit. By submitting inputs to the Services, you grant PingSolve LLC a worldwide, perpetual, irrevocable, non-exclusive, royalty-free license to use, reproduce, modify, process, and extract text from the audio for the purpose of operating, improving, and securing our Services and AI models.

7. PROHIBITED USES

Use the Services for any unlawful, fraudulent, or abusive purpose.
Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Services.
Attempt to bypass API quotas, usage limit controls, or premium token limitations.
Use automated tools (bots, scrapers) to extract transcriptions or compile information from our databases.

8. PAYMENTS & SUBSCRIPTIONS

Access to CustomCast includes a 3-day Free Trial (credit card registration required). Following the 3-day trial period, your account will be billed a one-time payment of $20 to unlock full usage (unless cancelled during the trial). Voice companion interaction requires credit consumption. Active subscriptions and credit packs are generally non-refundable except where required by law.

9. INTELLECTUAL PROPERTY

All right, title, and interest in and to the Services (excluding User Inputs and third-party video content), including but not limited to all software, code, UI design, text, logo elements, and audio processing algorithms, are and shall remain the exclusive property of PingSolve LLC or its licensors.

10. TERMINATION

We may suspend, restrict, or terminate your access to the Services at any time, for any reason or no reason, with or without notice, and without any liability to you.

11. DISCLAIMER OF WARRANTIES

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OR REPRESENTATIONS OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

12. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PINGSOLVE LLC BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, LOSS OF PROFITS, DATA, OR ENJOYMENT ARISING OUT OF YOUR USE OF THE SERVICES.

13. GOVERNING LAW & ARBITRATION

These Terms shall be governed by and construed in accordance with the laws of the State of Idaho. You and PingSolve LLC mutually agree that ALL disputes arising out of or relating to these Terms shall be resolved exclusively through final and binding individual arbitration administered by the American Arbitration Association ("AAA") in Boise, Idaho.

YOU AGREE THAT ANY AND ALL CLAIMS MUST BE BROUGHT SOLELY IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION.

14. YOUTUBE SERVICE COMPLIANCE

By using CustomCast, you agree to be bound by the YouTube Terms of Service located at https://www.youtube.com/t/terms.

15. MODIFICATIONS TO TERMS

We reserve the right to modify, update, or replace these Terms at any time. Changes are effective immediately upon posting. Your continued use of the Services constitutes your binding acceptance of the updated Terms.
